Woman in Her 30s Receives Prison Sentence for Unsubstantiated Rape Allegation, Highlighting Enhanced Legal Penalties

A woman in her 30s accused her biological father of rape after he declined to provide her with money, despite his previous financial support for her overseas education. She has now received a prison sentence.

On the 1st, the Namyangju Branch of the Uijeongbu District Court's Criminal Division 1, presided over by Judge Choi Chi-bong, sentenced a woman, identified as A, to 10 months' imprisonment for defamation, business obstruction, and insult.

A faced legal proceedings for posting 11 times in an online community between May and June of the previous year. Her posts, titled "I am a victim of familial sexual violence. Please look at this," were defamatory towards her biological father, B.

In these posts, she alleged that "I have suffered continuous sexual assault by my biological father since the age of four, and my mother also experienced domestic and sexual violence," "The issue was resolved with 30 million won in damages," and "Severe punishment is necessary."

During this period, A also disclosed B's actual name and business details, resulting in reported difficulties for B in managing his business.


 


A also made six postings asserting that B remarried a woman, C, with whom he allegedly had an affair.

In February 2021, A initiated a damages lawsuit over sexual assault against B at the Incheon District Court but was unable to substantiate any illegal actions.

During the criminal trial, A maintained that her statements were accurate; however, the court dismissed her assertions, referencing the lawsuit outcome. The court noted the absence of specific evidence or circumstances indicating habitual sexual assault by B.

The court deemed A's accusations false, taking into account that she received financial support from B during her overseas education and upon her return, and that the rape accusation followed shortly after a request for significant funds to operate a cafe, which B denied.


The court stated, "She disseminated false information about the victims due to dissatisfaction with financial support refusal. The reputations of the victims have been significantly harmed."


The court elaborated on the sentencing rationale, highlighting "the elevated risk of reoffending given her continuation of similar posts after the crime, and the victims' strong desire for severe punishment, which were key considerations."
